Continuous residence
common87 days to respondUSCIS questions whether you maintained continuous residence in the U.S.
What they are asking for
- Evidence you maintained residence in the U.S. during the required period
- Explanation of any trips outside the U.S. longer than 6 months
- Proof your primary home remained in the U.S.
What Answers It
- Tax returns for all years in the statutory period
- Passport pages showing all travel (entry/exit stamps)
- Lease or mortgage documents showing continuous U.S. address
- Utility bills, bank statements showing U.S. activity
- Employment records in the U.S.
- Children's school enrollment records
- If abroad 6+ months: evidence ties to U.S. were maintained
- Form N-470 (if you applied for preservation of residence)
Common Mistakes
- Not disclosing all trips outside the U.S.
- Not maintaining evidence of U.S. ties during extended travel
- Applying too soon after a long trip (wait until you rebuild continuous residence)
- Not filing taxes while abroad
Tips
- Trips of 6 months or less generally do not break continuous residence
- Trips of more than 6 months but less than 1 year create a presumption of broken residence (can be rebutted)
- Trips of 1 year or more break continuous residence unless an approved N-470 preserves it - a re-entry permit does not
- File N-470 BEFORE traveling if you expect to be abroad for over a year for work
- Keep meticulous records of all international travel
